The following terms and conditions (“Paisabazaar Bill Payments T&Cs”) are specific to the use of the bill payment product introduced by Paisabazaar Marketing and Consulting Private Limited (“Paisabazaar”, “We”, “Us”, “Our”, “Company”) which allows users to pay bills (or make pre-paid mobile recharge payments) from various Billers on Our Wesbite or Mobile App (“Paisabazaar Service platform/Platform”) including but not limited to Credit Card issuers, Loan Providers, electricity distribution companies, piped gas distribution companies, broadband companies, telecom companies, insurance companies etc. through an authorized Bharat Bill Payment Operating Unit
The Company is an Agent Institution (“AI”) onboarded by Axis Bank, an authorized Bharat Bill Payment Operating Unit (“BBPOU”) functioning in adherence to the standards set up by Reserve Bank of India (“RBI”) and Bharat Bill Pay Controlling Unit (“BBPCU”) registered with National Payments Corporation of India (“NPCI”)and RBI. Paisabazaar is facilitating the Bill Payment Service in the capacity of an Agent Institution.
All Users accessing the Paisabazaar Bill Payment Service shall be deemed to have read, understood and agreed to be bound by these Paisabazaar Bill Payment T&Cs.
DEFINITIONS
"BBPS” shall mean Bharat Bill Payment System Service under the supervision of NPCI/ RBI.
“Biller” shall mean a service provider who ultimately receives payments from Customers and participates in the BBPS through the BBPOU and shall be read with the meaning ascribed to the term in the Procedural Guidelines of NBBL (defined below).
“Biller Aggregator(s)” shall mean and include authorized banks and other financial institutions functioning as BBPOU with whom, Paisabazaar has direct arrangements for facilitating Bill Payment Service with respect to the Billers that are not covered under the NBBL’s BBPS framework.
"Bill" shall mean the amount paid by the Customer to Merchant (defined below)/Biller via Agent Institution for Bill Payment (defined below) which may include convenience/ service charge (if any) and all other taxes, duties, costs, charges and expenses (if any).
“Bill Payment” shall mean the Bill paid by the Customer, wholly or in part for the utility/ other Service provided by the Merchant/Biller.
“Bill Payment Service” shall mean and include the bill payment Service through the BBPOU duly covered under NBBL’s BBPS framework and also the bill payment Service wherein Paisabazaar has direct arrangement with Bill Payment Aggregator like Axis Bank.
“Merchant” shall mean the merchant providing all products/ Service to the Customer and shall include Paisabazaar for the purposes of this Bill Payment Services.
“OFF-Us” shall have the meaning ascribed to the term in the Procedural Guidelines of NBBL, where the Biller and payment collecting agent belongs to different BBPOUs other than Axis Bank;
“ON-Us” shall have the meaning ascribed to the term in the Procedural Guidelines of NBBL, where Biller and payment collecting agent belong to Axis Bank.
“Guidelines” herein refers to Implementation of Bharat Bill Payment System – Guidelines dated November 28th, 2014, issued by the RBI and guidelines provided by any appropriate authority, from time to time including any/ all amendments, additional circulars, as the case may be, and shall include Procedural Guidelines of NBBL.
“Procedural Guidelines of NBBL” shall mean Procedural Guidelines For Bharat Bill Payment System issued by the NBBL in December 2017 as may be amended from time to time.
"Transaction" shall mean every order or request placed by the Customer either as On-Us transaction or Off-Us transaction through Bill Payment Service on the Platform, for making payment of Bill to the Biller while using and accessing the Platform.
“You”, “Yours”, “Yourself”, “End User Customer”, “Customer”, “User” shall mean the individual who wish to avail Bill Payment Service over the Platform for making payments towards identified Billers.
1. Bill Payments

a. Paisabazaar shall enable you to pay your dues (or additional amounts) to the Billers using certain payment instruments. The payment instruments enabled may be changed by Paisabazaar at its sole discretion from time to time based on success rates or any other relevant consideration. Paisabazaar does not guarantee the availability of any particular payment instrument for Bill Payment on the Platform.
b. Paisabazaar shall process the payment to the Biller only after Paisabazaar has successfully received the payment from your UPI, Debit Card, Credit card or other relevant payment instrument. Paisabazaar shall not be responsible for any delay occasioned due to any action or inaction on account of any bank or payment gateway involved in your transaction.
c. You agree to not hold Paisabazaar responsible and/or liable for any issue or claim arising out for any dispute whatsoever between You and the Biller, the payment gateway or Your bank
d. Once a bill payment has been initiated and successful it cannot be reversed.
e. While Paisabazaar undertakes its best efforts to process the payment as directed by you at the earliest, Paisabazaar may delay, suspend, or reject a transaction for any payment(s) for any reason, including without limitation if we suspect the transaction poses a financial or security risk, or is unauthorized, or is fraudulent, suspicious, unlawful or in any way in violation of the applicable laws around such transactions or in violation of these Terms or otherwise unusual in any manner. Paisabazaar shall in no manner be responsible for the delays/reversal or failure of the aforesaid Transactions..
f. You agree to not hold Paisabazaar liable for delays in bill payment arising from Biller's end. Paisabazaar recommends You to pay your bills early to avoid late payment fees, if any, being levied by the Biller.
g. Your access to Bill Payment Service through the Platform may be suspended or terminated or blocked or disabled permanently if Paisabazaar has reasonable grounds to suspect that information provided by You are untrue, inaccurate, incomplete, or not in accordance with the Terms provided herein or are in contravention to any Guidelines or in case of any suspicious or fraudulent activity by You on the Platform.
h. We further reserve the right to terminate or suspend your access to our service at any time, without prior notice, in the event of a court order or other legal directive requiring such action. We may also terminate your access for violations of these Terms of Use or for any other reason at our sole discretion. Upon termination, you may lose access to your account, data, and any associated Service.
3. Customer Obligations for information provided

You understand and acknowledge that the responsibility for providing correct information/ details, including payment details such as details of the Biller/bill number, amount of the bill etc., lies solely with You and the Company shall not be responsible for verifying the accuracy of the information/details provided by You.
a) In the event of any information provided by Your Biller, You agree that it shall be Your responsibility to verify such information before initiating the bill payment.
b) You agree and acknowledge that Paisabazaar shall not be responsible for any discrepancy in the bill details and in the event of any discrepancy in the bill details, You would be required to coordinate with the Biller directly without the involvement of Paisabazaar.
c) You also agree that You will only make genuine payments/ transactions, and that Paisabazaar may decline or reverse the transaction if it suspects that the transaction is not genuine. You agree not to use the Bill Payment Service for money laundering, terrorist financing, illicit payments or any other use which is either prohibited by law or is unethical.
d) You agree that You are responsible for all transactions conducted through the Bill Payment Service and in the event of any wrong payment made to an incorrect party, Paisabazaar shall not be liable to reimburse You or reverse such payment. In the event of any wrong payment made, Your sole remedy will be to approach the Biller or party to whom the payment was made.
e) By making a payment for a Credit Card, Loan EMI or any other Biller, that does not belong to You, You assume FULL responsibility for the aforesaid transactions.
5. Disclaimer

The Bill Payment Service are provided to You on the Platform on an “as is” basis. The Company, its agents or partners do not provide any representation and/or warranty of any kind to the Bill Payment Service made available on the Paisabazaar platform.
a) The Bill Payment Service are made available on the Platform through (i) aggregators or (ii) the BBPOU registered Billers.
b) The payments made by You through the Bill Payment Service are solely between You and the Biller and Paisabazaar will not be liable in any way for any losses You may suffer as a result of a transaction facilitated by the Company on Your instructions.
c) Paisabazaar shall not be liable for any delay, errors or failures in the bill payment initiated by You through the Bill Payment Service.
d) You shall be solely responsible for providing accurate details, including account numbers, operator information, and payment values, at the time of transaction.
e) Bill Payment Service should not be construed as the Company providing or reselling any of the Service provided by Your Biller.
f) The Company does not provide any warranty as to the Bill Payment Service being uninterrupted, timely or error-free or free of defects.
PAISABAZAAR DISCLAIMS WITHOUT LIMITATION, ANY WARRANTY OF ANY KIND WITH RESPECT TO THE BILL PAYMENT SERVICE, NONINFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. PAISABAZAAR DOES NOT WARRANT (i) THAT THE BILL PAYMENT SERVICE WILL MEET YOUR REQUIREMENTS; AND (ii) THAT ANY PRODUCTS, INFORMATION OR MATERIAL OBTAINED BY YOU IN CONNECTION WITH THE BILL PAYMENT SERVICE WILL MEET YOUR REQUIREMENTS. PAISABAZAAR SHALL NOT BE RESPONSIBLE FOR ANY SYSTEM RELATED FAULTS THAT MAY AFFECT THE RECEIPT, PROCESSING, ACCEPTANCE, COMPLETION OR SETTLEMENT OF TRANSACTIONS) THAT YOU MAY FACE ON THE PLATFORM WHETHER OR NOT CAUSED BY PAISABAZAAR. IT IS YOUR RESPONSIBILITY TO EVALUATE THE ACCURACY, COMPLETENESS AND USEFULNESS OF THE BILL PAYMENT SERVICE AND OTHER INFORMATION PROVIDED BY PAISABAZAAR. WE DO NOT AUTHORIZE ANYONE TO MAKE ANY WARRANTY ON OUR BEHALF AND YOU SHOULD NOT RELY ON ANY SUCH STATEMENT.
6. Indemnity & Liability

You hereby agree to defend, indemnify, and hold harmless Paisabazaar, its affiliates, employees, officers, directors, shareholders, agents, representatives from and against any and all claims, actions, suits, proceedings initiated against it and any loss, cost or damage, expenses (including legal fees) incurred by it as a result of:
Your wrongful access or use of the Bill Payment Service.
Your violation of these terms and conditions, policies, guidelines provided/updated by us from time to time specifically regarding any fraudulent payments made by You through the Bill Payment Service.
Your actual or alleged violation of any law, rules or regulations or
any third-party claims arising out of Your access and use of the Bill Payment Service.
In no event will Paisabazaar be liable for any direct or indirect, consequential, incidental, special or punitive damages liabilities (including statutory), including without limitation damages for loss of profits or revenues, business interruption, loss of business opportunities, loss of data or loss of other economic interests, whether in contract, negligence, tort or otherwise, arising from the use of or inability to use the Platform.
You will be liable for any kind of loss or damage resulting from Your breach of these Terms & Conditions, Your negligence, or as a result of any unauthorized, fraudulent acts, You agree that, if You are not satisfied with the Bill Payment Services or any portion thereof, Your sole remedy shall be to stop using the Bill Payment Services.
11. Supplemental Terms and Conditions

By accessing the Paisabazaar Bill Payment Service,
a) You hereby agree that Paisabazaar may access SMS from or regarding Billers, bill reminders and bill payment confirmations to identify the Billers that You interact with (Relevant Billers), subject to You having granted SMS read permission to the Paisabazaar App (applicable for android version only). You agree that You may not be able to use Paisabazaar Bill Payment Service at all or effectively without granting the aforementioned SMS permissions.
b) You agree that upon Relevant Billers being identified by Paisabazaar, Paisabazaar shall from time to time fetch from the Relevant Billers or through BBPS payment system, the bill details and payment status in relation to your account with the Relevant Billers, and Paisabazaar may display such information to You on its Platform and/or send You reminders of Your outstanding dues to such Relevant Billers - on WhatsApp, SMS, Email, RCS or through IVR
c) In the event that You wish to stop receiving updates in relation to a Relevant Biller identified by Paisabazaar, You may reach out to our customer care and notify regarding the same. You may also add a new Biller not identified automatically by Paisabazaar, by adding the Biller details and your account details using Our Platform.
d. You understand and acknowledge that while Paisabazaar uses its best efforts to ensure accuracy of the information displayed on the Paisabazaar platform, such information is derived from SMS, Billers, and other sources which may not be error free. Paisabazaar does not guarantee the accuracy or error free nature of the information displayed as a part of Paisabazaar Bill Payment. Paisabazaar recommends you to verify your bill details before making a payment
e. You understand and acknowledge that Paisabazaar may also use your bureau data (Credit History) to fetch bills details and payment status in accordance with RBI guidelines
We endeavor to execute and process transactions as per the defined process, however, We, shall not be held responsible for any non-responsiveness, delay, failure of systems or any other circumstances that might not be in Our control. We reserve the right to change/modify the Terms, at any time and without notice. You can determine when the Terms were last modified by referring to the “Last Updated” legend above. However, We shall not undertake to update You with the content contained herein from time to time. You are obliged to exercise Your independent diligence on the same before arriving at any decision and You will be solely responsible for Your actions. We shall not be held responsible for all or any actions that may subsequently result in any loss, damage and or liability on account of such change in the information in the Terms. Your continuous use of the Paisabazaar following the posting of changes shall mean that You accept and agree to the changes and shall be legally bound by the same. You acknowledge and agree that the Bill Payment Service shall be subject to these Terms.
These Terms and Conditions mentioned herein and all matters arising under or in connection with these Terms, including the construction, validity, performance or termination thereunder, shall be governed by and construed in accordance with the laws of India. The courts in Gurugram, Haryana shall have exclusive jurisdiction over all matters connected with the Bill Payment Services.
